For the past few years, hemp-derived products such as THCA flower, delta-8 gummies and THC-P vapes have been sold online across much of the United States under the 2018 Farm Bill’s definition of hemp. That is about to change. A federal law passed in November 2025 rewrites the definition of hemp, and its first provisions start on November 12, 2026.

This article explains the timeline and what it could mean if you shop at Binoid, one of the larger online hemp retailers. It is general information, not legal advice. Facts about the law come from Congressional Research Service (CRS) reports; product details and prices come from Binoid’s website as checked on 4 November 2026.

    Key Dates at a Glance

    DateWhat happens (per CRS)
November 12, 2025P.L. 119-37 amends the federal definition of hemp
September 2, 2026Congress passes P.L. 119-103, delaying most of the changes
November 12, 2026Products with cannabinoids not capable of being naturally produced by the cannabis plant are excluded from hemp
December 11, 2026Most other changes take effect, including the total THC standard and the 0.4 mg per container cap

    What the New Definition Changes

According to CRS, the 2018 Farm Bill set a limit of 0.3% delta-9 THC on a dry weight basis. The new definition uses total THC instead, which reflects that delta-9 is not the only potentially intoxicating THC in the plant. CRS notes that the Senate Appropriations Committee said the aim was to prevent the unregulated sale of intoxicating hemp products.

The new definition also excludes several groups of products from the meaning of hemp, according to CRS:

    • Hemp-derived cannabinoid products containing cannabinoids that are not capable of being naturally produced by the cannabis plant.
    • Products with naturally occurring cannabinoids that were synthesized or manufactured outside the plant.
    • Intermediate products with more than 0.3% combined total THC and similar cannabinoids.
    • Final products with more than 0.4 milligrams combined total THC and similar cannabinoids per container.

CRS says products that fall under these exclusions would be treated as marijuana under the Controlled Substances Act once the relevant provisions take effect.

The law also asked the Food and Drug Administration to act. According to CRS, it required the FDA to publish, within 90 days of enactment, lists of naturally occurring cannabinoids, THC-class cannabinoids and other known cannabinoids with similar effects, and to further define the term container. Those lists and definitions will shape exactly which products fall inside or outside the new limits, so they are worth following if you buy hemp products regularly.

    Why There Are Two Dates

The original law was due to take effect in full on November 12, 2026, one year after enactment. On September 2, 2026, Congress passed a continuing resolution that, according to CRS, delays most of the changes until December 11, 2026. The exclusion for cannabinoids that cannot be naturally produced by the plant was allowed to start as planned on November 12. CRS also notes that other bills have been introduced to delay the changes by two more years or to repeal them, so the picture could shift again.

What This Could Mean for Binoid Products

Jar of Binoid mixed CBD and THC gummies

Binoid’s best sellers on 4 November 2026 were dominated by gummies and vapes. Examples include the Super 7 Gummies 7000mg at $39.97, Delta 9 THC Gummies at $30.99 and the Delta 8 THC Gummies at $29.99. Many of these products list blends of several cannabinoids. Under a 0.4 mg per container cap, most intoxicating gummies sold today would appear to exceed the new limit once it applies.

Vapes are also a major category. Binoid listed its THCA Vape Cartridge with live rosin at $30.99 and disposables from 1 to 7 grams, such as the Blazed THCA + Delta 9P 3 gram disposable at $37.99. How each product is treated will depend on its cannabinoids and how they were made, which is why lab reports matter more than ever.

We cannot say how Binoid will change its range or when, and the company had not posted a notice about the new rules on its homepage when we checked. If you rely on a particular product, check the product page and Binoid’s customer service for updates.

    Rules That Already Apply

Even before the federal change, Binoid’s own site sets limits. It says its delta products are not for sale to anyone under 21, and it lists states it does not ship to. On 4 November 2026 Binoid said it does not ship delta products to California, Oregon, Alaska, West Virginia, Washington or Colorado, and that THCA products cannot be shipped to a longer list of states including Arkansas, Idaho, Kansas, Louisiana, Oklahoma and Utah. State laws can be stricter than federal law, so check your own state’s rules.

    Practical Tips for Shoppers

    • Read the Certificate of Analysis (COA) for any product before buying, and check total THC, not just delta-9.
    • Note the date: rules change on November 12 and December 11, 2026, and orders in transit may be affected.
    • Do not stockpile on the assumption that products will remain legal to possess; the status of each product may change.
    • Check your state’s laws, which may already restrict some cannabinoids.
    • Keep all products away from children and pets; edibles such as gummies and brownies can look like ordinary sweets.

    Final Thoughts

The hemp market in the US is entering its biggest change since 2018. The exact impact on any single product will depend on how regulators apply the new definition, and Congress may still change the timeline. For now, the best approach is to stay informed, read lab reports and follow official sources. You can see Binoid’s current range and product information at Binoid’s website.
